Liv's Law: Understanding Ohio's New DUI Penalties and Legal Implications

Ohio has recently enacted new legislation aimed at reducing the incidences of Operating a Vehicle Impaired (OVI) offenses. Dubbed “Liv’s Law”, these changes bring about significant alterations to penalties and legal implications for individuals convicted of OVI. This blog aims to share these developments and how they may impact the community and our client’s lives. 


Liv’s Law Explained


Liv’s Law was enacted in response to a tragic incident involving a young girl named Olivia, whose life was cut short due to an impaired driver. The new legislation seeks to honor her memory by imposing stricter penalties on those found guilty of OVI, in turn aiming to enhance road safety across Ohio. These penalties went into effect on April 9, 2025.


What are the enhanced penalties? 


Liv’s Law introduces a tiered penalty system based on the severity of the offense and the offender’s history. First-time offenders will face increased fines, longer license suspensions, and mandatory participation in alcohol or drug education programs. Repeat offenders, or those with extremely high Blood Alcohol Concentration (BAC) levels, will be subject to harsher penalties including extended jail time and permanent license revocation. 

Other Significant Changes:

  • Ignition Interlock Devices: Individuals convicted of OVI will be required to install IIDs in their vehicles, preventing the vehicle from starting if alcohol is detected on the driver’s breath. This measure aims to prevent offenses and ensure that individuals comply with the law. 
  • Mandatory Sentencing Guidelines for OVI convictions: Judges will have less discretion in reducing sentences or offering probation for offenders, ensuring that penalties are uniformly applied. The hope is that potential offenders will be deterred by the severe consequences. 


What should Ohioans know about the legal implications of this new law? 


First, individuals charged with OVI should be aware of the increased risk of more severe penalties. Legal counsel becomes even more important in order to navigate the complexities of the law.
